Nexity Bank's Privacy Commitment

Nexity Bank is committed to respecting the individual privacy of consumers. We value the trust you have placed in us to maintain the security and confidentiality of your financial information. Nexity Bank promises to use the information about you in a responsible manner and we believe it is important for you to be informed about our efforts to safeguard your privacy. Nexity Bank has adopted the following privacy policy to demonstrate this commitment.

Privacy Policy

At Nexity Bank, we have no higher priority than the security and privacy of your financial information. This information is essential for us to provide you with the superior customer service that you deserve and we consider it a valuable asset that requires our protection. We only grant access to nonpublic personal information about you to employees, affiliates and service providers in order for them to provide or offer financial products and services. We do not sell your information to outside marketers.

In addition, we maintain physical, electronic and procedural safeguards that comply with federal standards to protect your personal information. Nexity Bank continually monitors and reviews all of its security protection measures and as improved practices or new technology becomes available, we will adopt those that we believe may enhance the security of your confidential financial information.

In the following sections you will find our policies regarding the collection, use and disclosure of customer information. These policies describe the types of information that are collected, and how and why that information may be shared with others.

Information Collection

We collect nonpublic personal information about you from the following sources:

  • Information we receive from you on applications or other forms;
  • Information about your transactions with us, our affiliates, or others; and
  • Information we receive from a consumer reporting agency.

Information Use and Sharing

We do not disclose any nonpublic personal information about our customers or former customers to anyone, except as permitted by law.

Information Sharing with Third Parties Permitted by Law

We may disclose all of the information we collect, as described above, to companies that perform marketing services on our behalf or to other financial institutions with whom we have joint marketing agreements.

Opt Out Rights

If you prefer that we do not share with our affiliate, Nexity Financial Services, Inc., the information we collect from you or about you, you may direct us not to share this information by completing the Opt Out form below. If you do not wish to exercise your opt out rights, you do not need to do anything. We do not intend to share with any of our other affiliates.

If we receive an opt-out election from you and there are other individuals on your account or co-borrowers on your loan, we will treat it as an opt out election by all joint account holders and co-borrowers.

Online Privacy

We restrict access to nonpublic personal information about you to those employees who need to know that information to provide products or services to you. We maintain physical, electronic, and procedural safeguards that comply with federal standards to guard your nonpublic personal information.

When you visit our website to view any page or read product information, you do so without telling us who you are and without revealing any personal information. The only information that we normally collect and store is:

  • The name of your Internet Service Provider,
  • The website that referred you to us (if any),
  • The type of browser used,
  • The page or pages you requested.

Nexity Bank uses cookies to facilitate online experience with us. Cookies are pieces of data assigned by a web server to the browser on your PC. Without revealing your identity, cookies help us confirm your identity when you login to your account using NexSecure multifactor authentication. Nexity also uses a feature called “session” cookies that are created when you log in to review your secured account information. This session cookie is destroyed when you exit your online account access. Nexity Bank does not collect any personal information using cookies.

There are instances where you may elect to provide us with personal information. If you fill out one of our contact forms or quick applications or if you send us an e-mail, you are transmitting the information that appears to you in the form or message. This will typically include information like your name, mailing address, e-mail address, the kind of request you are making and any other information necessary to fulfill your request. You do not transfer personally identifying information that you do not enter yourself. This information is used internally only for the purpose of fulfilling your request or for contacting you directly and is not sold to any other organization.

When you input nonpublic personal information via one of our Quick Applications or Applications, that information is encrypted or scrambled by your browser before it is transmitted back to our website. This effectively prevents anyone from intercepting and reading any personal information about you. Encryption is in place when you use your web browser with one of our website application forms and while accessing your account
information. Please do not send any nonpublic personal information to us in an e-mail. Encryption does not take place if you send us e-mail, which is not a secure form of communication with us.

Information Integrity

Nexity Bank works hard to ensure that our customer's information is complete and accurate. Your role in this process is to conduct a timely review of all statements, bills and notices that we provide you and to notify us of any discrepancy. Nexity Bank occasionally may contact you about our product and service offerings by telephone or e-mail. When we contact you, we do not request any personal information (such as your PIN or password) and limit our inquiries only to the information necessary to identify you as our customer. Current affiliates include Nexity Financial Corporation, Nexity Investments, Inc., Nexity Financial Services, Inc., Nexity Portfolio Managment Group, Inc., and Nexity Insurance Inc. "You" or "yours" refers to each individual who is one of our customers or former customers who obtained or requested a financial product or service from us. This Privacy Policy applies to consumers who are Nexity Bank customers or former customers in the United States.
